Dorsey – DOJ to Develop New Whistleblower Program to Augment Existing Federal Whistleblower Programs

The U.S. Department of Justice (DOJ) will soon begin a pilot program to reward whistleblowers who alert prosecutors to significant corporate misconduct. Given DOJ’s broad mission, the program will fill in gaps from other more limited programs, such as those operated under the SEC and the CFTC. In this eUpdate, we describe the core requirements and challenges of the program, how the program will fill in the gaps with existing whistleblower programs, how the program fits within DOJ’s corporate enforcement policies, and we provide some recommended takeaways.
