Wellness Watch: Guidance Is (Almost) Here

SUMMARY. New EEOC Proposed Regulations for Wellness have finally clarified what it means to be "voluntary" under the Americans with Disabilities Act (ADA) but have left several unanswered questions because of the disconnect between what the Affordable Care Act (ACA) permits and what the EEOC’s Proposed Regulations permit.
