Letters of Protest: An Attractive Alternative to a U.S. Opposition

SUMMARY. A Letter of Protest (LOP) is an informal mechanism that a trademark owner may use to prevent another party from registering its mark at the U.S. Patent and Trademark Office. Understanding the benefits and limitations of the LOP, however, is critical to its success. This article explains the LOP process, discusses when to file and when not to file a LOP, and provides practical advice that will enhance the enforcement strategy of every trademark owner.
