Please support HB 705 – This will give Montana restaurants the option of offering “corkage” – Bring your own wine to dinner.
There is a bill, HB 705, working its way through the legislature that would allow licensed restaurants to allow customers to bring their own bottle of wine and charge a corkage fee if they choose. Restaurants without a license are still not allowed to do so. I have included a link to that bill below. The relevant section is 16-6-306 (3) on page 20. If passed, that part of the bill would become effective immediately. Please let me know if you have additional questions.
Nothing in this section prohibits a licensed on–premises retailer OR CONCESSIONAIRE from opening and serving to patrons 21 years of age or older wine from a sealed bottle brought to the premises by the patron for on–premises consumption. This service may not constitute a violation of 16–3–301 or this section,4regardless of whether the licensed retailer charges a corkage fee.
