The U.S. government launched CAPE, an online platform allowing importers of record and customs brokers to file claims for refunds on tariffs the Supreme Court ruled unconstitutional. This follows a significant Supreme Court decision restricting presidential authority over tariff policy enforcement.

The tariffs, imposed between April 5, 2025 and February 24, 2026 under the International Emergency Economic Powers Act, were invalidated because the Court found the law did not authorize such trade measures. Eligible businesses can submit claims through ace.cbp.dhs.gov with a cap of 9,999 entries per submission. Refunds are expected by direct deposit within 60 to 90 days after approval. About 80% of eligible importers had registered as of last week. Senator Ed Markey emphasized the importance of returning money to small businesses and families, while noting concerns over whether consumer prices will truly reflect these refunds.

Businesses can start filing claims via CAPE as of the portal’s opening, with the option to submit multiple claims if needed.

Although Montana was not specifically mentioned, businesses in the state could leverage this portal to recoup tariffs paid on imported goods, potentially affecting local supply costs. Given Montana’s industries that may rely on imports, timely access to refunds could potentially influence operational expenses and pricing strategies.
