Civil Forfeiture Now Requires A Criminal Conviction In Montana And New Mexico

Just in time for the Fourth of July, states are declaring their independence from civil forfeiture.
The high school aged son of a business friend had his pickup confiscated and sold in civil forfeiture. The truck was being used by other students, whether the pickup was willingly loaned, or whether it was a case of bullying/coercion I don't know. In any case, the young man was not involved in the crime, but still had his vehicle confiscated and sold. This was not a case of the justice system being just.
