Inside Entrepreneurship: Trademark law can be tricky on protecting names

Q: Here’s a trademark challenge for you. In the late ’60s, I changed the spelling of my last name to create a more unique identity for my music recording. One recording became a hit. I’ve since learned from doing online searches that a woman performing R&B changed her last name to MY name! I’m the victim of identity theft! I created the spelling. It’s my brand name. I’ve been selling music since 1969 — long before she changed her name. Even though I never officially filed trademarks shouldn’t I have common law protection?
