New Independent Contractor Rules for Montana

In 2003, the Montana Supreme Court threw out the conclusive nature of the state’s independent contractor exemption. Without that conclusive presumption, independent contractors would be subject to mandatory workers’ compensation insurance coverage. The Montana Chamber served on an advisory group with other businesses, labor and government representatives to address the issue. The result was SB 108 which requires that independent contractors, who are NOT exempted in the legislation, have a certificate issued under this new law if they want that conclusive presumption.

There are important requirements under this new law for both independent contractors and the businesses who hire them.

Following is information compiled by the Montana Department of Labor and Industry about SB 108. The law went into effect April 28, 2005. The Department is finalizing rules which will be retroactive to that date.
